Oregon Attorney Representing Clients in SSD Appeals
At the law office of Richard A. Sly, Attorney at Law, we have over 30 years of experience handling a wide range of initial and appellate Social Security Disability (SSD) cases for clients in Portland, Oregon metropolitan area including Vancouver, Washington and across the Southwest Washington area. There are many steps in the process once your claim has been denied. We can explain all of the steps in filing an appeal, which is a common occurrence since over 65% of initial applications are denied.
Constructing Your Appeal
After an initial claim for Social Security Disability benefits is denied, we may immediately begin gathering evidence and constructing your appeal. Our firm is exceptionally skilled at putting together all of the documentation that is needed for an appeal.
The Reconsideration Phase
Once we have put all of your appeal paperwork together, it is submitted to the Social Security Administration (SSA). The SSA will then review your appeal and reconsider their earlier decision to deny the claim. This process overall tends to take about four to six months. At the end of this phase, about 55 to 60% of all claims remain denied.
The Hearing
After an appeal is filed and following reconsideration, we can file a request for a hearing in front of an administrative law judge (ALJ) in the Portland metro office. However, there is an extensive wait to actually have the hearing held. Recently the wait time was averaged at between 18 and 24 months.
Do not get discouraged. We will pursue the benefits you deserve to the fullest extent that the law will allow.
